1. Introduction

Market Securities ("Market Securities," "we," "us") is committed to protecting the privacy and security of your personal information. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights you have.

This policy applies to all users of our website, mobile applications, and brokerage services (the "Services"). It should be read together with our Cookie Policy, which addresses cookies and similar tracking technologies, and our Disclosures, which address how we handle information in connection with regulated brokerage activities.

Market Securities is a U.S.-registered broker-dealer. As such, we are subject to the privacy and safeguarding requirements of Regulation S-P (17 CFR § 248), the Gramm-Leach-Bliley Act, and applicable state laws, in addition to the privacy obligations described here.

2. Information We Collect

Account and identity information. When you open an account we collect your full legal name, date of birth, residential and mailing address, telephone number, email address, taxpayer identification number (e.g., SSN or ITIN), employment information, and government identification documents. We also collect beneficial-ownership information for entity accounts.

Transaction and account-balance information. We collect information about the orders you place, positions you hold, balances, transfers, dividends, interest, and corporate actions. We also collect funding-instrument details such as bank-account numbers (used to verify and route ACH and wire transfers) and card tokens.

Device and connection information. We collect IP address, browser type and version, operating system, device identifiers, mobile-carrier information, and timezone and language preferences. We may also collect precise or coarse location derived from your IP address or device sensors.

Usage and interaction information. We collect information about how you use the Services, including pages or screens viewed, features used, AI Copilot and copy-trading activity, search queries, in-app messages, support interactions, and telemetry such as session duration and tap or click events.

Information from other sources. We may receive information from identity-verification vendors, credit bureaus, sanctions and watchlist providers, market-data vendors, clearing and banking partners, and public records. We may also receive information from third parties if you link an external account or share data via open-banking or aggregation services.

3. How We Use Information

We use your information to open, maintain, and service your account; to verify your identity and comply with AML, KYC, OFAC, and tax-reporting obligations; to execute, settle, and clear your trades; to calculate fees, margin, and buying power; and to deliver statements, confirmations, and tax documents.

We use your information to provide and improve the Services, including the AI Copilot, copy trading, watchlists, alerts, charts, and analytics. Aggregated or de-identified information may be used for product research, model training, performance monitoring, and analytics.

We use your information to communicate with you about your account, product changes, security issues, and (with your consent where required) marketing and educational content. We also use it to detect, prevent, and respond to fraud, market abuse, security incidents, and other prohibited conduct.

We use your information to comply with legal obligations, respond to legal process, and protect the rights, property, and safety of Market Securities, our Users, and the public. Where we rely on a legal basis under applicable privacy law (such as the GDPR or CCPA), we process information under contract, legal obligation, legitimate interest, or consent as further described below.

4. How We Share Information

We share information with our clearing firm, executing brokers, banks, and other financial institutions as necessary to settle your trades, fund your account, and operate the Services. For example, we share order information with market centers and clearing partners to execute and settle transactions.

We share information with service providers and processors that perform functions on our behalf, such as identity verification, data storage, cloud hosting, analytics, customer support, communications, and fraud detection. These processors are contractually bound to protect information and to use it only as we direct.

We share information with regulators, self-regulatory organizations (such as FINRA), exchanges, and law-enforcement agencies when required by law, regulation, subpoena, or court order, or when we believe disclosure is necessary to comply with legal obligations, protect against fraud, or protect the rights and safety of others.

We do not sell your personal information to third parties for monetary consideration. We do not share your personal information with non-affiliated third parties for their own marketing purposes without your opt-in consent. We may share information in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to confidentiality obligations.

5. Cookies & Similar Technologies

We use cookies, web beacons, pixels, local storage, and similar technologies to operate, secure, and improve the Services, remember your preferences, measure performance, and (with your consent where required) deliver relevant content and advertising. Details about the specific cookies and how to manage them are in our Cookie Policy.

Essential cookies are necessary for the Services to function (for example, to keep you logged in or to secure transactions). Analytics and functional cookies help us understand usage and improve features. Marketing cookies, when enabled, support measurement and personalization across our partners' platforms.

6. Data Retention

We retain your personal information for as long as your account is active and for additional periods required by law, regulation, or legitimate business need. Brokerage records are generally retained for at least six (6) years under SEC Rule 17a-4 and FINRA Rule 4511, and certain records may be retained longer.

When you close your account, we will de-identify or delete your personal information where we are not legally required to retain it. We may retain information in backup systems for a reasonable period as part of our disaster-recovery procedures.

7. Security

We maintain administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, use, alteration, or disclosure. These include encryption in transit and at rest, segmented network architecture, least-privilege access controls, multi-factor authentication, and continuous monitoring.

We require our service providers to implement comparable safeguards and we conduct security reviews of critical vendors. Despite our efforts, no system is perfectly secure, and we cannot guarantee the absolute security of your information.

If we become aware of a security breach affecting your personal information, we will notify you and the appropriate regulators as required by applicable law, and we will take reasonable steps to mitigate its effects.

8. Your Privacy Rights

If you are a U.S. resident, you may have rights under state privacy laws such as the California Consumer Privacy Act (CCPA) and the Colorado Privacy Act. Subject to exceptions, these rights may include the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising your rights.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) and equivalent laws, including the right to access, rectify, erase, restrict, or port your personal data, the right to object to processing, and the right to withdraw consent at any time without affecting processing that was previously carried out.

To exercise any of these rights, contact us at privacy@marketsecurities.com. We will verify your identity before responding and may decline requests that are fraudulent, impracticable, or prohibited by law. You may also lodge a complaint with your local data-protection authority.

9. Children's Privacy

The Services are not directed to, and are not intended for use by, anyone under the age of eighteen (18). We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us at privacy@marketsecurities.com and we will delete it.

Custodial accounts (such as UGMA/UTMA accounts) are opened by an adult custodian on behalf of a minor beneficiary. In those cases we collect information about the custodian and the minor beneficiary as required to administer the account, and the custodian is responsible for any consent required for the minor's use of the Services.

10. International Data Transfers

Market Securities is headquartered in the United States and may process and store your information in the United States and other countries where we or our service providers operate. When we transfer personal data from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Agreement, or another recognized transfer mechanism.

By using the Services from outside the United States, you acknowledge that your information may be transferred to and processed in the United States, which may have data-protection laws that differ from those in your jurisdiction.
